The Brazilian lawful interception system, has particular characteristics.
After receiving the official notice from the authority, the operator begins a series of procedures to respond to the judge's request. Communication data and content is sent to the authority, often via the open pulbic network where there may be no guarantee of confidentiality.
Typical problems include:
- Delayed delivery of information
- Missed calls
- Congestion
- Non-optimized link
- Instable connection
- Non-correlated data
This opens up the possibility of fraud and technical problemas which may jeopardize the generation of reliabel evidence.
In Brazil, the utilization rate in lawsuits of information generated through interceptions is low - even lower if IP connections are also analyzed.
